When a crime occurs, a criminal report or an investigation request is filed with the police. The police conduct a pre-trial investigation to determine the suspected criminal event. During this process, the police interrogate the suspect, hear the victim and potential witnesses, and gather evidence. Having a lawyer's assistance is often beneficial already at the pre-trial investigation stage.
After the police investigation, the case is forwarded to the prosecutor for prosecutorial consideration. Based on the pre-trial investigation, the prosecutor decides whether to file charges.
If the prosecutor decides to press charges, the case will be heard in court. The court issues a ruling determining the penalty for the crime. It is advisable for the defendant to have legal representation during the trial to respond to the charges and the plaintiff's claims, as well as to ensure proper defense.
During the trial, the court may also rule on compensation claims, which the victim (plaintiff) is entitled to due to damages suffered as a result of the crime. Seeking professional legal assistance is recommended for forming and presenting compensation claims in court.
